By accessing or using the ABC Foam Creations customer portal, you agree to be bound by these Terms & Conditions. Your use of this portal constitutes an electronic signature of agreement pursuant to the Florida Electronic Signature Act (§668.50, Fla. Stat.) and the Federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. §7001).

1. Portal Use & Access

This portal is provided exclusively to customers of ABC Foam Creations for the purpose of reviewing quotes, approving projects, submitting change requests, and tracking job status. Unauthorized access or use is strictly prohibited.

2. Quote Approval & Binding Agreement

By clicking "Approve Quote," you authorize ABC Foam Creations to proceed with the described scope of work at the quoted price. This constitutes a binding agreement under the Florida Uniform Commercial Code (§672, Fla. Stat.). A deposit may be required prior to commencement of work. Title and risk of loss transfer in accordance with Florida UCC provisions.

3. Changes, Cancellations & Late Payments

Change requests are subject to review and may result in a revised quote. Cancellations after approval may incur a cancellation fee based on project stage and materials ordered. Outstanding balances are subject to interest at the legal rate under Florida Statute §687.01.

4. Consumer Protections

Nothing in these terms waives your rights under the Florida Deceptive and Unfair Trade Practices Act (FDUTPA, §501.201, Fla. Stat.). ABC Foam Creations is committed to fair and transparent business practices.

5. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Miami-Dade County, Florida.

Electronic signature events (IP address, timestamp, browser information, and document hash) are recorded pursuant to the Federal E-SIGN Act (15 U.S.C. §7001) to maintain a legally defensible audit trail.

2. How We Use Your Information

Your information is used solely to operate this portal — to authenticate your identity, deliver sign-in links, display your quotes and project status, and process approvals or change requests. We do not use your data for marketing or sell it to any third party.

3. Data Security & Breach Notification

We implement industry-standard security measures to protect your data. In the event of a data breach affecting your personal information, we will notify you and, where required, the Florida Department of Legal Affairs in accordance with FIPA §501.171.

4. Children's Privacy

This portal is not directed to children under the age of 13. We do not knowingly collect personal information from minors in compliance with the Children's Online Privacy Protection Act (COPPA).

5. Your Rights & Complaints

You may request access to or deletion of your personal data at any time. Complaints regarding our privacy practices may be escalated to the Florida Attorney General's Consumer Protection Division or the Federal Trade Commission (FTC).

6. Governing Law & Jurisdiction

This Privacy Policy is governed by the laws of the State of Florida. Disputes shall be resolved in Miami-Dade County, Florida.
